Agreement to Terms

By using SmartMove Erie Towing services, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

We reserve the right to update these terms at any time. Your continued use of our services after changes are posted means you accept the new terms.

Service Description

SmartMove Erie Towing provides emergency towing, roadside assistance, flatbed towing, long-distance towing, motorcycle towing, accident recovery, winching, junk car removal, and heavy-duty towing services in Erie, CO and surrounding areas.

We operate 24 hours a day, 7 days a week. Response times may vary based on weather conditions, traffic, distance, and the availability of our tow trucks.

Payment and Fees

You agree to pay all fees for services provided. Payment is due at the time of service unless other arrangements have been made in advance.

We accept cash, credit cards, and debit cards. If your vehicle is impounded, storage fees may apply according to Colorado state regulations. You will be notified of any storage fees before they are charged.

If payment is not received, we reserve the right to place a lien on your vehicle as permitted by Colorado law.

Your Responsibilities

When you request our services, you must provide accurate information about your location, vehicle type, and situation. This helps us send the right equipment and respond quickly.

You are responsible for removing all personal belongings from your vehicle before it is towed. While we take reasonable care of your vehicle, we are not responsible for items left inside.

You must have the legal right to authorize towing of the vehicle. We may ask for proof of ownership or authorization before providing service.

Liability and Insurance

SmartMove Erie Towing carries insurance as required by Colorado law. We take every precaution to handle your vehicle safely during towing and transport.

We are not liable for damage that existed before we arrived, damage caused by the condition that required towing, or damage to custom modifications that you did not inform us about.

Our liability is limited to actual damages directly caused by our negligence, up to the current value of your vehicle. We are not responsible for consequential damages such as lost wages, rental car costs, or inconvenience.

Cancellations

If you need to cancel a service request, please call us immediately at (720) 764-0336. If our driver has already been dispatched and is en route to your location, a cancellation fee may apply to cover fuel and time costs.

Disputes and Governing Law

These terms are governed by the laws of the State of Colorado. Any disputes will be handled in the courts of Boulder County, Colorado.
